Brad Pitt Requesting Joint Custody of Children

The entertainment world was shocked in mid-September 2016 when power couple Angelina Jolie and Brad Pitt announced their divorce.

Jolie filed a petition for divorce from Pitt citing “irreconcilable differences” for the reason behind their divorce. This was amid rumors that Pitt had a physical confrontation with their eldest son, Maddox, on a private jet.

TEMPORARY CUSTODY ARRANGEMENT REACHED

Jolie and Pitt agreed to a temporary custody deal where Pitt could visit his six children as long as the children were supervised. Pitt has since requested joint custody of his children.

Jolie has requested joint legal custody and sole physical custody of the children.

LEGAL CUSTODY VS PHYSICAL CUSTODY

In the state of California, there are two types of custody:

  • Legal
  • Physical

Legal custody gives a parent the right to make major decisions about the health, education, and welfare of a child. Some examples of this type of custody include:

Deciding where a child will attend school
Deciding if a child will participate in religious activities (and which activities)
Deciding what type of medical care the child should receive (this excludes emergency situations)
Physical custody refers to where a child will live after the separation or the divorce. The parent with physical custody has the right to have the child present in their home.

SHARING JOINT CUSTODY WITH ANOTHER PARENT

The courts encourage children to share both types of custody whenever possible, which often leads to a joint legal and joint physical custody situation.

Joint legal custody means both parents have the right and responsibility to make major decisions for the child. Joint physical custody gives both parents the right to have the child with them for significant periods of time.

If the divorcing parents cannot agree on custody, they will end up in court where a judge will then make the custodial decisions based on what is in the best interest of the child.
