What Rights Do Fathers Have Under California Law?
Under California Family Code section 3011, courts evaluate custody based on the best interests of the child, a standard that applies equally to both parents. Fathers have the right to seek physical and legal custody, participate in decisions about their child’s health, education, and religious upbringing, and receive child support if they are the custodial parent.
A few points fathers should understand from the start:
- Filing for divorce doesn’t strip your rights. Existing parental rights remain in effect unless a court order modifies them.
- Being on the birth certificate isn’t enough. Being named on a birth certificate or paying child support doesn’t automatically establish custody rights. Those must be formally granted by the court.
- Sexual orientation is not a factor. California law expressly prohibits courts from considering a parent’s sexual orientation in custody determinations.
